IE "SunSay" (hereinafter – the Service Provider)
This public offer (hereinafter – the Offer) is an Agreement concluded between the Service Provider and the service user – an individual (hereinafter – the Customer), which defines the terms of acquisition and provision of services using the Service Provider’s resources.
1.1 The Service Provider publishes this Offer addressed to individuals in accordance with Articles 395, 396, and 447 of the Civil Code of the Republic of Kazakhstan (hereinafter referred to as the Civil Code of the Republic of Kazakhstan).
1.2 This Offer, like any Agreement, defines the essential terms of the relationship between the Service Provider and the Customer (the person who has accepted the Offer).
1.3 This Offer is concluded between the Service Provider and the Customer upon the placement of an order for services and the Customer's full payment for the services.
1.4 The Offer may be accepted by any individual within the Republic of Kazakhstan who intends to order (purchase) services provided by the Service Provider in accordance with the list of services listed on the website https://hedonistlist.me. The Customer unconditionally accepts all terms and conditions contained in the Offer in their entirety (i.e., in full and without exception).
1.5 By accepting the terms and conditions of this Offer, the individual becomes the Customer.
1.6 Acceptance is deemed to be the Service Provider’s receipt of a notice of the individual's intent to order services under the terms and conditions set forth in this Offer and the Customer's full payment for the services.
1.7 The Offer, all amendments and appendices thereto, as well as all additional information about the Service Provider’s services, are published on the website https://hedonistlist.me.
1.8 The Service Provider reserves the right to unilaterally amend the terms of the Offer. Amendments take effect upon publication on the website and do not apply to previously concluded agreements.
2.1 The website is owned by the Service Provider and is intended to facilitate the remote sale of services online.
2.2 By accepting the Offer (i.e., paying for an order placed on the Service Provider’s website), the Customer will receive services under the terms and conditions specified in the Service Provider’s Service Agreement, which is posted on the website https://hedonistlist.me.
2.3 The Service Provider is not responsible for the content or accuracy of the information provided by the Customer when placing an order on the Service Provider’s website.
3.1 The Customer is responsible for the accuracy of the information provided when placing the order and its freedom from claims by third parties.
3.2 The Customer confirms their agreement with the terms and conditions set forth in this Offer by checking the box "I have read the Terms of the Agreement in full, I understand all the terms of the Agreement, I agree with all the terms of the Agreement" when placing an order.
3.3 Information provided by the Customer is confidential. By providing their personal data, registering on the website, or completing an application, the Customer consents to the processing of their personal data for the purposes of fulfilling this Service Agreement. The Service Provider uses the Customer’s information solely for the purposes of the Service Provider’s operations (sending notifications to the Customer regarding order fulfillment, etc.) and in cases specified in this Offer. Consent is given to the processing of personal data for the purposes of contract performance, settlements, sending notifications, and compliance with legal requirements. Consent is valid until the processing purposes are achieved and may be revoked by sending written notice. Processing is carried out in accordance with the Privacy Policy posted on the website.
3.4 Services are purchased by the Customer solely for personal, family, and household needs not related to business activities. Using the Service Provider’s website (resource) to view and select services, as well as to place an order, is free of charge for the Customer.
4.1. The Service Provider, based on the Customer's orders, sells services to the latter in accordance with the terms and conditions and at the prices set by the Service Provider on the website.
4.2 The provision of services ordered and paid for by the Customer is carried out by the Service Provider or third parties engaged by the Service Provider to fulfill its obligations.
4.3 The provisions of the Civil Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On the Protection of Consumer Rights", as well as other regulatory legal acts of the Republic of Kazakhstan governing the rights and obligations of the Parties specified in this Offer shall apply to the relations between the Customer and the Service Provider.
4.4 An individual is deemed to have accepted all terms of the Offer (acceptance) and appendices thereto in full and without exception upon the Service Provider’s receipt of the Customer's notice of their intention to order services under the terms offered by the Service Provider and the Customer's full payment for the services. Upon acceptance of the Offer, the individual is deemed to have entered into a Service Agreement with the Service Provider and acquires the status of Customer.
5.1 The Customer may place an order independently on the Service Provider’s website or through a Service Provider specialist by phone at the number listed on the website, subject to the terms of the Service Agreement.
5.2 When placing an order on the Service Provider’s website, the Customer is required to provide the following information:
● Full name;
● Contact phone number;
● Email address;
5.3 The Customer expresses their intent by entering the relevant information in the order form on the Service Provider’s website, or by submitting an application through a Service Provider specialist using information and telecommunications tools or by email.
5.4 The Service Provider does not edit information about the Customer.
6.1 Information about the Service Provider’s services is provided on the Service Provider’s website through graphic images and information that are the property of the Service Provider.
6.2 Each graphic image is accompanied by text information with the name, price, and description of the services.
6.3 At the Customer’s request, a Service Provider specialist is obligated to provide (by email) any other information necessary and sufficient, in the Customer’s opinion, to enable them to make a decision regarding the ordering of the services.
7.1 The Customer has the right to place an order for any service provided on the Service Provider’s website. Each service may be ordered in any quantity. Exceptions to this rule are specified in the description of each service.
7.2 After placing an order, the Service Provider confirms the Customer's order by emailing the Customer confirmation of acceptance, indicating the name, type, and characteristics of the service, along with the total order amount.
8.1 The price listed on the Service Provider’s website is in Kazakhstani tenge.
8.2 The price listed on the website may be changed unilaterally by the Service Provider, but the price for services ordered and paid for by the Customer remains unchanged.
8.3 The cost of services provided to the Customer when ordered on the Service Provider’s website is indicated in the "Payment" section.
9.1 Payment is made online via internet acquiring through the PlexyPay payment system.
9.2 Payments for the order will be made in Kazakhstani tenge.
10.1 The Customer has the right to refuse services in the manner and under the conditions stipulated by the Law of the Republic of Kazakhstan "On Protection of Consumer Rights".
10.2 The Customer has no right to refuse services that have been properly performed (rendered).
10.3 If the Customer refuses services, the Service Provider will refund the Customer the amount paid under the contract, less the Service Provider’s expenses actually incurred in connection with the fulfillment of obligations.
10.4 Refunds will be made within 21 business days of receipt of the Customer's written request.
11.1 The Parties shall be liable in accordance with the laws of the Republic of Kazakhstan.
11.2 The Parties shall be exempt from liability for failure to perform or improper performance of their obligations under the Offer during the duration of a force majeure event.
11.3 The Service Provider’s liability shall be limited to the amount actually paid by the Customer. The Service Provider shall not be liable for lost profits, consequential damages, or moral damages, unless otherwise provided by mandatory provisions of the laws of the Republic of Kazakhstan.
12.1 The relationship between the Customer and the Service Provider is governed by the laws of the Republic of Kazakhstan.
12.2 If necessary, the Service Provider and the Customer may at any time formalize a service agreement in the form of a written bilateral agreement that does not conflict with the provisions of this Offer.
12.3 If the Customer has any questions or complaints, the latter should contact the Service Provider by email at info@hedonistlist.me.
12.4 This Offer shall enter into force on the date of its acceptance by the Customer and shall remain in effect until the Parties have fully fulfilled their obligations under it.
12.5 All disputes and disagreements arising from the performance of the Parties' obligations under this Offer shall be resolved through negotiations. If they cannot be resolved through negotiations, the Parties have the right to seek resolution of such disputes in the courts of the Republic of Kazakhstan in accordance with the procedure established by current legislation.
12.6 The Service Provider reserves the right to expand or reduce the general offering of services on the website, regulate access to ordering any services, and suspend or terminate the sale of any services at its sole discretion.
